Boston Proper Brands We Love Marketplace Terms & Conditions

Boston Proper Brands We Love Marketplace provides certain third-party sellers (“Marketplace Sellers”) the opportunity to sell and ship their products (“Marketplace Products”) directly to you through the Site. These Boston Proper Marketplace Terms (“Marketplace Terms”) supplement the Boston Proper Terms & Conditions, and apply to your use of Boston Proper Brands We Love Marketplace and purchase of Marketplace Products. In the event of any irreconcilable conflict between these Marketplace Terms and the Boston Proper Terms & Conditions or other policies, these Marketplace Terms will govern solely with respect to Marketplace Products. All capitalized terms used but not defined in these Marketplace Terms have the meaning set forth in the Boston Proper Terms & Conditions. We reserve the right to make changes to these Marketplace Terms at any time in accordance with the Boston Proper Terms & Conditions.

THESE MARKETPLACE TERMS ARE SUBJECT TO THE CLASS ACTION WAIVER, JURY TRIAL WAIVER AND BINDING INDIVIDUAL ARBITRATION AGREEMENT SET FORTH IN THE BOSTON PROPER TERMS & CONDITIONS.

Prices
Prices of Marketplace Products are set by Marketplace Sellers and are subject to change at any time. Price matching and price adjustment policies for Marketplace Products are set forth in the Terms & Conditions . Boston Proper’s coupon codes, discounts and promotions will not be applicable to Marketplace Products, unless expressly stated otherwise on the website. 

Payments
Boston Proper (or its service provider) will process payments for Marketplace Products.. As between Boston Proper and the Marketplace Seller, Boston Proper will handle any payment-related disputes, refunds, credits, charge backs and adjustments, as applicable, with respect to Marketplace Products.

Shipment & Fulfillment
You acknowledge and agree that Marketplace Products are sold to you by Marketplace Sellers, and the Marketplace Sellers, not Boston Proper, will be solely responsible for order fulfillment and shipping the Marketplace Products. Marketplace Sellers will be provided your name and shipping address solely to complete order fulfillment and shipping. Marketplace Sellers will not be provided and will not have access to any other information or yours, including your payment information. All Marketplace Products purchased must ship standard.

Returns
Marketplace Products will be returned to the applicable Marketplace Seller, subject to the Boston Proper Return Policy. Marketplace Products may not be exchanged.

TO THE FULLEST EXTENT PROVIDED BY APPLICABLE LAW, YOU ACKNOWLEDGE AND AGREE THAT BOSTON PROPER IS NOT AND WILL NOT BE LIABLE OR RESPONSIBLE FOR MARKETPLACE PRODUCTS OR FOR THE MARKETPLACE SELLERS (OR ANY OF THEIR ACTIONS OR OMISSIONS).

Disputes
Any disputes between you and Boston Proper will be subject to the Dispute Resolution procedures in the Boston Proper Terms & Conditions.
